The appointment of the DERC chairwoman, usually a formality, has become embroiled in the ongoing conflict between the city’s major political factions.This prolonged conflict escalated after the Centre passed an ordinance on May 19 that nullified a Supreme Court ruling from May 11 that gave the elected government of the state control of the bureaucratic machinery in all departments, with the exception of those pertaining to land, public order, and police.

On June 21st, the Delhi government officially proposed Sangeet Lodha, a retired judge, for the role. The Aam Aadmi Party (AAP) government condemned the “illegal and unconstitutional” appointment of Kumar to the seat by the Centre later that day.Electricity, the party argued, properly belongs under state control, and the “aid and advice of the elected administration” must be followed.

On July 4, the apex court ruled that the Delhi government could delay giving Kumar his oath of office.

The appointment order was issued on June 21 under Section 45D of the Government of National Capital Territory of Delhi (GNCTD) Ordinance, 2023, which the bench agreed to review on the same day. The Centre, through the LG, has final say over who serves on all commissions, bodies, and authorities in the Capital Region under Section 45D of the legislation.

The Supreme Court called CM and LG to the stand at Monday’s case hearing and said, “We want to know if it is possible to break this impasse. Why can’t the LG and the CM, as two constitutional officers, meet and agree on a single candidate to run for DERC? Either you cooperate with the established systems or you don’t. They need to put aside their differences and work together.Senior counsel Abhishek Manu Singhvi, speaking for the Delhi government, first argued that it is unrealistic to expect the two officials to agree on a single name.
“But I don’t have a problem if they can miraculously agree,” he continued.

Replying to the court’s request, LG’s lead attorney Harish Salve said his client agreed that the two constitutional functionaries should get down together to work out the dispute.

It’s a shame the Delhi government’s counsel has already given up. We should immediately say “yes” and “we will do it,” as Salve put it.

The bench, presided over by India’s Chief Justice Dhananjaya Y. Chandrachud, also considered whether to refer the Delhi government’s separate appeal to the ordinance to a five-judge constitution bench.

DERC was established in 1999 to regulate the distribution and pricing of electricity in the nation’s capital. The position has been open since (ret.) Justice Shabihul Husnain resigned on January 10 due to retirement. There is now only one person serving on the panel of three.

After surpassing the previous record of 207.49 meters at 1 p.m., the Yamuna reached 207.72 meters by 4 p.m., according to a representative of the Central Water Commission.

Kejriwal stated in a tweet that the water level in the Yamuna is rising despite “no rains in Delhi” over the past two days due to “abnormally high volumes of water being released by Haryana at the Hathna Kund barrage.” The chief minister requested intervention from the federal government to prevent the Yamuna’s water level from rising further.

Later, at a press conference, the Aam Aadmi Party (AAP) chief stated that Union Minister Gajendra Shekhawat informed him that the amount of water being discharged from Himachal Pradesh to Haryana has decreased, which will have an effect on the Yamuna’s water level.

However, he stated that it will take some time for the river’s water level to decrease.

The elevation of the Yamuna

The last time the Yamuna attained its highest water level was in 1978, when it surpassed 207.49 meters. Current Yamuna water level is 207.55 meters.

According to the Central Water Commission’s (CWC) flood-monitoring portal, the water level at the Old Railway Bridge surpassed 207 meters for the first time since 2013 at 4 a.m., and reached 207.55 meters by 1 p.m., shattering the 1978 record.

The river is expected to ascend to 207.72 feet and then remain stable, according to a CVC forecast.

On Monday night, the river surpassed the evacuation threshold of 206 metres, prompting the relocation of residents from flood-prone areas to safer locations and the closure of the Old Railway Bridge to vehicular and rail traffic.

There were significant floods in Delhi in 1924, 1977, 1978, 1995, 2010, and 2013.

This comes one day after the convener of the Aam Aadmi Party conferred with the leader of the Nationalist Congress Party to gain support for the issue. Pawar supported Kejriwal and stated that he would reach out to other states to cultivate consensus among opposition parties, describing the Centre’s ordinance as an attack on parliamentary democracy. Kejriwal had also met Uddhav Thackeray at his residence Matoshree in Mumbai prior to his meeting with Pawar.

The chief minister of Delhi already has West Bengal’s Mamata Banerjee on his side in his fight against the ordinance limiting the administrative powers of the Delhi government. The leader of the Trinamool Congress assured Kejriwal that her party will oppose the legislation when it is introduced to parliament.

The decision was made hours after chief minister Arvind Kejriwal stated that there were rumors that the Union government would introduce an ordinance to overturn the May 11 verdict.

Education minister Atishi later stated that the ordinance violated the Supreme Court’s authority. “The Centre’s ordinance is an evident violation of the Supreme Court Constitution Bench’s ruling that the elected government should have decision-making authority (regarding services matters). In a statement, Atishi explained that the central government introduced the ordinance out of fear that the authority would fall into the hands of Chief Minister Arvind Kejriwal’s government.

She added, “It is evident that the central government is afraid of Arvind Kejriwal and the Supreme Court’s ruling, which is why they have introduced this ordinance in defiance of the Supreme Court.”

The Constitution bench of the apex court ruled on 11 May that officers working in all departments other than those relating to public order, land, and police fell under the administrative and legislative control of the Delhi government, putting an end to a dispute that began with a notification issued by the Union government eight years ago and resulted in a lengthy court battle with conflicting verdicts.

However, Friday’s ordinance nullified the ruling.

“The central government has seized the services-related authority granted to the elected government of Delhi by the Supreme Court’s Constitution bench. The people of Delhi re-elected Arvind Kejriwal for a third time, but the Centre asserts that the imposed lieutenant governor will have transfer and assignment rights, giving him control over every aspect of government. This is an affront to the Supreme Court, said Delhi’s minister of services, Saurabh Bharadwaj.

The ordinance was criticized by senior Congress leader Abhishek Singhvi, who represented the Delhi government before the apex court. “Clearly, this is the act of a vile, impoverished, and ungraceful loser. It is unlikely that constitutional principles can be weakened by ordinances or laws. Greater uncertainty exists as to whether Parliament as a whole will ratify it,” he added.

The leader of the BJP in Delhi, Virendra Sachcdeva, stated that his party applauds the decision made by the Centre.

“Delhi is the nation’s capital, the whole of India has jurisdiction over it, and the Arvind Kejriwal administration has long harmed the administrative dignity of Delhi. The corruption of this government has also caused a great deal of embarrassment for Delhi, and given the manner in which the government of Arvind Kejriwal has attempted to defame the administration of Delhi and act arbitrarily over the past week, the BJP endorses the ordinance,” said Sachdeva.

Previously, Kejriwal had expressed concern over the potential promulgation of an ordinance.

“I pray these rumors are unfounded. If true, this would be a grave betrayal of the people of Delhi and the nation. The decision was rendered by the Supreme Court’s constitution chamber, and it must be respected by all. “After many years, the people of Delhi have received justice, and they are pleased that the government they elected will be able to work for them,” Kejriwal stated.

He spoke after meeting with the LG, whom the AAP claimed was dragging his feet in authorizing a file removing Ashish More as services secretary.

The impasse, which began hours after the court’s ruling on 11 May, when the Delhi government ordered More’s removal, lasted for nine days.

Friday evening, ministers demonstrated at the office of the LG. Later, lead by Kejriwal, they participated in a videotaped meeting with the LG.

“I asked the LG when he will approve the services secretary’s file for transfer. The LG stated he will send it…I am hopeful that the LG will submit the file in a timely manner, as the position of services secretary is crucial to the administrative reorganization we wish to implement. Therefore, the services secretary must be replaced, Kejriwal stated after the meeting.

The LG signed the order to replace More with AK Singh on Friday evening.

What is the Delhi ordinance?

The Union government issued an ordinance on Friday stating that the Centre will be in charge of “services” in the National Capital Region. A week earlier, the Supreme Court ruled that the Delhi government has authority over NCT services and Delhi government bureaucrats.

In accordance with the ordinance, the Lieutenant Governor has the ultimate authority and sole discretion regarding the transfer and posting of bureaucrats. The ordinance established for the very first time the National Capital Civil Service Authority, a new service commission for Delhi.

The Delhi government and the LG were once again at odds over the transfer of Services Secretary Ashish More following the Supreme Court’s decision. The LG was unable to approve his transfer file. More complained to the CS that Delhi minister Saurabh Bharadwaj had a personal grudge against him.

The Supreme Court had ordered that the elected government be granted the authority to make independent decisions in accordance with its will and the principles of democracy. However, the Centre’s ordinance demonstrates that the Modi administration is a ruthless loser. Atishi stated that the sole purpose of this ordinance is to strip the Kejriwal government of its authority.

Aam Aadmi Party’s trade wing secretary Sandeep Bhardwaj committed suicide on Thursday. Sisodia also mentioned this in the press conference. Said- It is not right to do politics on this.
