<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">Clause (100) of section 10 of the IT Act exempts from income tax any amount received under a life insurance policy, including the amount allocated as a bonus on such a policy, with certain exclusions.</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">This provision has been amended pursuant to The Finance Act, 2023, inter alia, by replacing the extant sixth proviso with the new sixth, seventh, and eighth provisos to, inter alia, stipulate that:</span></span></p>
<p class="lastPara" style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; font-family: Lora, sans-serif; font-size: 20px; background-color: #ffffff;">(i) From the assessment year 2024-25, the sum received under a life insurance policy, other than a unit-linked insurance policy, issued on or after the first day of April 2023, shall not be exempt under the said clause if the premium payable for any of the previous years exceeds Rs 5,00,000 [sixth proviso];</p>

<p class="lastPara" style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; font-family: Lora, sans-serif; font-size: 20px; background-color: #ffffff;">(ii) if a premium is payable for more than one life insurance policy, other than a unit-linked insurance policy, issued on or after April 1, 2023, the exemption under the said clause shall be available only with respect to such policies if the aggregate premium for any of the previous years during the term of any of those policies does not exceed Rs 5,00,000 [seventh proviso];</p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; font-family: Lora, sans-serif; font-size: 20px; background-color: #ffffff;">(iii)The sixth and seventh stipulations do not apply to money acquired as a result of someone&#8217;s death [eighth stipulation].</p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif; font-size: 20px;">Further, a new clause (xiii) </span><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">provisions for taxation of amounts received under life insurance policies that are not otherwise exempt from taxation under the IT Act have been added to subsection (2) of section 56 by the board.</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">In the circular, it was explained that &#8220;&#8230;if any sum is received, including the amount allocated by way of bonus, at any time during a previous year, under a life insurance policy (other than the sum)—maybe received under a unit linked insurance policy or being the income referred to in clause (iv) of sub-section 2—which is not to be excluded from the total income of the previous year in accordance with the provisions of clause (10D) of section 10, the sum so received as exceeds the sum so</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">The CBDT has also added clause (xviid) to section 2&#8217;s clause (24) to specify that any amount mentioned in clause (xiii) of section 56&#8217;s subsection (2) counts as income.</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">The amount received under any unit-linked insurance policy (except any such sum received on the death of a person) issued on or after the 01.02.2021 shall not be exempt under said clause if the amount of premium payable for any of the previous years during the term of such policy exceeds Rs 2,50,000 (fourth proviso) or Rs 2,750,000 (seventh proviso) (Finance Act, 2021). Exemption under the said clause shall be available only with respect to such policies where the aggregate premium does not exceed Rs 2,50,000 for any previous years during the term of any of the policies (fifth proviso), and only if the premium is payable for more than one UUPs issued on or after 01.02.2021.</span></span></p>

<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">As part of the circular, the tax authority offered guidance for complying with the provisions of the aforementioned clause. Here are some of them:</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">(i) Any life insurance policy (other than a unit-linked insurance policy) issued on or after 0 1.04.2023 is a &#8220;eligible life insurance policy&#8221;;</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">(ii) In the context of a qualified life insurance policy, &#8220;consideration&#8221; refers to any payment made under the policy, including bonuses.</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; background-color: #ffffff;"><span style="font-family: Lora, sans-serif;"><span style="font-size: 20px;">(iii) When referring to a &#8220;current prior year,&#8221; it indicates the prior year in which the receipt of consideration is being reviewed for any tax implications.</span></span></p>
<p style="margin: 0px 0px 20px; padding: 0px; border: 0px; outline: 0px; box-sizing: border-box; list-style: none; font-family: Lora, sans-serif; font-size: 20px; background-color: #ffffff;">If the consideration received in the previous year under an eligible life insurance policy is exempt under clause (100) of section 10 of the Act, further conditions must be met.</p>

										<content:encoded><![CDATA[<p><span style="font-size: 16px;">Messages purporting to be from banks, credit cards, or KYC services that are sent to individuals to deceive them are extremely prevalent at present. The latest fraud that is currently going viral targets taxpayers and is similar to the bogus PAN update hoax.</span></p>
<p><span style="font-size: 16px;">According to an official tweet from PIB Fact Check, &#8220;a circulating message claims the recipient has been approved for a Rs 15,490 income tax refund.&#8221; According to the tweet, the message states, &#8220;You have been approved for a tax refund of Rs 15, 490. The amount will be credited to your account number 5xxx6755. If this information is incorrect, please amend your bank account details by clicking the link below.&#8221;</span></p>
<p><span style="font-size: 16px;">Users should be aware that the IT department will not provide a link for a refund if one is due. In addition, you should avoid entering your debit or credit card information on websites to which you are sent a link via SMS, as this could be a phishing scam designed to take your card information.</span></p>
<p><span style="font-size: 16px;">The Department of Income Tax does not request comprehensive personal information via e-mail and does not send e-mails requesting PIN numbers, passwords, or other similar access information for credit cards, banks, or other financial accounts.</span></p>

<p><span style="font-size: 12pt;">If you receive an e-mail from someone claiming to be the authorized by Income Tax Department or directing you to an Income Tax website:</span></p>
<ul>
<li><span style="font-size: 12pt;">Do not reply.</span></li>
<li><span style="font-size: 12pt;">Do not open any attachments. Attachments may contain malicious code that will infect your computer.</span></li>
<li><span style="font-size: 12pt;">Do not click on any links. If you clicked on links in a suspicious e-mail or phishing website then do not enter confidential information like bank account, credit card details.</span></li>
<li><span style="font-size: 12pt;">Do not cut and paste the link from the message into your browsers, phishers can make link look like real, but it actually send you to different websites.</span></li>
<li><span style="font-size: 16px;">Protect your computer with up-to-date firewall, anti-malware, and anti-spyware software. Certain phishing emails may inadvertently have malware that will damage your machine or monitor your online activities.Firewalls, anti-virus programmes, and anti-spyware utilities can all help prevent you from unwittingly downloading malicious software.</span></li>
</ul>
<p><span style="font-size: 14pt;"><strong>Fake ITR reporting</strong></span></p>
<p><span style="font-size: 16px;">The official Income Tax website states, &#8220;If you receive an email or find a website you think is pretending to be of Income Tax Department, forward the email or website URL to webmanager@incometax.gov.in.&#8221; Incidents can also be reported via email to incident@cert-in.org.in. You can either forward the email as received or provide the Internet header. The Internet header contains additional metadata that can be used to track down the sender. Once you&#8217;ve forwarded the email or header information to us, you can safely delete the original message.</span></p>
<p><span style="font-size: 16px;">ITR status checks are available both before and after logging in. Once you have logged in and checked the status of your ITR, you will have access to further features, such as downloading the return or intimation. If you want to use this service without logging in, you&#8217;ll need to submit a valid ITR acknowledgement number.</span></p>

<p><span style="font-size: 12pt;">The income tax refund status can be tracked on the government&#8217;s new income tax portal by following the steps below:</span></p>
<p><span style="font-size: 16px;">1. Visit www.incometax.gov.in, input your PAN or Aadhaar number as your user ID, and your password to access your account.</span></p>
<p><span style="font-size: 12pt;">2. Once logged in, select the &#8216;e-file&#8217; tab. Select &#8220;Income Tax Returns&#8221; under &#8220;e-file,&#8221; followed by &#8220;View Filed Returns.&#8221;</span></p>
<p><span style="font-size: 12pt;">Step 3: Check the latest ITR filed.</span></p>
<p><span style="font-size: 12pt;">Step 4: Select &#8216;View Details&#8217; option.</span></p>
<p><span style="font-size: 12pt;">Once the ITR is selected, the filing status will be shown. It will also show the date tax refunds were issued, the amount of the return, and the date the refund was cleared.</span></p>

The biggest gift in this is regarding the tax free limit. Means now taxpayers will have to pay less tax on their salary or say that more part of the salary will be tax free.</p>
<h2>Income tax basic exemption limit may increase in the budget</h2>
<p>In simple words, if a part of your salary up to Rs 2.5 lakh is tax free. No tax has to be paid on this. Those earning less than Rs 2.5 lakh are also exempted from filing income tax return. The country&#8217;s budget is to come on 1 February. In this budget, the tax free limit (Income tax basic exemption limit) can be increased. If sources are to be believed, the income tax free limit can be increased from Rs 2.5 lakh to Rs 3 lakh. In the existing rules, till now for the general public (taxpayers), there is no tax on income up to 2.5 lakhs. Whereas, for senior citizens, this limit is Rs 3 lakh. Talking about super senior citizen (80 years), then this limit is 5 lakh rupees.</p>

The government had increased the income tax free limit (income tax basic exemption limit) from Rs 2 lakh to Rs 2.5 lakh. But, since then there was no change in the income tax slab in the last 9 years. But, this year 2023 is the last full budget of the second term of the Modi government. In such a situation, everyone from economist to financial expert is assuming that the tax free limit will increase. The limit can be increased from 2.5 lakh to 3 lakh.</p>
<h2>There can be a big change in Income Tax slab as well</h2>
<p>If sources in the Finance Ministry are to be believed, there is going to be a change in the income tax slab this year as well. In the current income tax slab, income up to Rs 2.5 lakh is not taxed (Income tax basic exemption limit). Income between Rs 2.5 lakh to Rs 5 lakh is taxed at 5%. There is a direct tax of 20% on income between 5 to 10 lakh rupees. But, this year there can be a 10% tax cut for this slab. Means income up to 10 lakhs can be brought in the slab of 10%. Such a step can be taken to rationalize the tax slab. Income up to Rs 10-15 lakh can also be taxed at 15%.</p>
<p>In the budget of the year 2017-18, the then Finance Minister late Arun Jaitley had reduced the tax burden on the income group from Rs 2.5 lakh to Rs 5 lakh. He reduced the tax on this slab from 10% to 5%. Under Section 87A of the Income Tax Act, 1961, the rebate was reduced from Rs 5,000 to Rs 2,500 for those earning between Rs 2.5 lakh and Rs 3.5 lakh. In such a situation, this time the expectation of increasing the income tax basic exemption limit is very high.</p>

Under this, the total income up to Rs 2.5 lakh is tax free.</p>
<p>Thereafter 5% on total income from Rs 2.5 lakh to Rs 5 lakh, 10% on total income from Rs 5 lakh to Rs 7.5 lakh, 15% on income from Rs 7.5 lakh to Rs 10 lakh, from Rs 10 lakh Income up to Rs 12.5 lakh is taxed at 20%, income from Rs 12.5 lakh to Rs 15 lakh is taxed at 25% and income above Rs 15 lakh is taxed at 30%. However, this scheme did not attract much attention from the taxpayers, as in many cases taxpayers had to pay more tax on adopting it.</p>

<p>Experts believe that in order to make the Optional Tax Regime more attractive, Finance Minister Nirmala Sitharaman should increase the limit of tax-free income and peak tax rate in the upcoming budget, as well as some popular tax deductions. should be included.</p>
