										<content:encoded><![CDATA[<p>After the Constituent Assembly of the erstwhile State of<strong> Jammu and Kashmir</strong> was dissolved on January 26, <strong>1957</strong>, the Supreme Court on Wednesday questioned whether the President&#8217;s power to declare inoperative Article 370 of the Constitution, which granted special status to Jammu and Kashmir, will not continue to hold field.The President had the authority to declare <strong>Article 370</strong> &#8220;inoperative&#8221; or to make changes to it under its third clause. But a provision had made it &#8220;necessary&#8221; that the Jammu and Kashmir (J&amp;K) Constituent Assembly endorse such a step.Unlike the Parliament or the <strong>Supreme Court,</strong> the Constituent Assembly does not exist in perpetuity. There can be no permanent Constituent Assembly.</p>

<p>The State of Jammu and Kashmir&#8217;s Constituent Assembly was formed for the sole purpose of writing the state&#8217;s constitution. After the J&amp;K Constitution was written, it became the law of the land. This stipulation, which would necessitate a&#8217;recommendation&#8217; from the Constituent Assembly in order to abrogate, is irrelevant. Even if the provision no longer applies, the rest of<strong> Clause 3 of Article 370</strong> remains in effect. On the first day of hearing, Chief Justice<strong> D.Y. Chandrachud</strong>, presiding over a Constitution Bench, made oral observations.The senior counsel <strong>Kapil Sibal</strong> argued that since the J&amp;K Constituent Assembly has been dissolved, Article 370 cannot be abolished because it requires the assembly&#8217;s approval.Mr. Sibal, representing <strong>Mohd.</strong> Akbar Lone and the petitioners, questioned,<strong> &#8220;Are you saying the President has blanket powers?&#8221;</strong>Can J&amp;K&#8217;s citizens&#8217; voices be muzzled or stifled in this way? In the last five years, there has been no representative democracy in J&amp;K.</p>

<p>We have systematically dismantled democracy in the name of restoring it. Unlike princely states who joined the Union, the State of J&amp;K has always had a special connection with the United States. He questioned the legitimacy of the court&#8217;s decision,<strong> &#8220;Can that unique relationship between two sovereigns be jettisoned like this?</strong>&#8220;Mr. Sibal questioned how Parliament could have abrogate Article 370 by declaring itself the legislature of J&amp;K in place of the J&amp;K Constituent Assembly. According to the Constitution, Parliament was established. It was impossible for it to violate the Constitution, he argued. After putting the State Legislature on ice, the Governor effectively became the de facto head of state.</p>

<p>Asaduddin Owaisi, the leader of AIMIM, stated on Tuesday that while the Modi government is erasing the Mughal history from textbooks, China is erasing India&#8217;s present.</p>
<p>The remark is made amid a heated debate over the NCERT&#8217;s rationalization of the CBSE textbooks. In his criticism, Owaisi referred to the issue of China naming 11 places in Arunachal Pradesh and stated, &#8220;On the one hand, the Modi government is erasing the Mughals history from the NCERT curriculum, while China, with whom PM Modi was shaking hands at the G20 Indonesia meeting, is erasing our present.&#8221;</p>
<p><strong>Dispute over Mughal history at NCERT</strong></p>
<p>It is a falsehood, according to NCERT director Dinesh Prasad Saklani, that chapters on the Mughals have been removed from CBSE textbooks. &#8220;There was a process of rationalisation last year. There was strain on students everywhere because of Covid,&#8221; the NCERT director said, adding that the expert committee recommended dropping the chapters that will not affect the students&#8217; knowledge. &#8220;The history of the Mughals is covered in Empires, section 2 of the 11th grade textbook. In the textbook for class 12 there were two chapters on the history of the Mughals; theme nine was withdrawn last year, while theme eight is still being taught. This year, no book has had a chapter removed,&#8221; said Saklani.</p>
<p>&#8220;Modern Indian history should begin in 2014,&#8221; said Sibal Rajya Sabha MP Kapil Sibal. &#8220;Modi ji&#8217;s Bharat&#8221; is consistent with the deletion of Mughal chapters. &#8220;Modern Indian history should begin in 2014,&#8221; joked Kapil Sibal.</p>

										<content:encoded><![CDATA[<p>In the midst of a political uproar over Rahul Gandhi&#8217;s &#8220;democracy under attack&#8221; remarks in the United Kingdom, Rajya Sabha member Kapil Sibal stated on Wednesday that criticising the government, whether at home or abroad, is a citizen&#8217;s right and does not equate to criticising India or being unpatriotic.<br />
The remarks made by Mr. Gandhi during his recent visit to the United Kingdom have shocked Parliament, with both Houses neglecting to conduct significant business during the first three days of the second half of the budget session.</p>
<p>Former Union minister Sibal stated in a tweet: &#8220;Why Is There a Logjam in the Home? Government and India are not synonymous, and neither is Government and India synonymous. It is a citizen&#8217;s privilege to criticise the government at home and abroad. This does not constitute criticism of India or unpatriotism.&#8221; &#8220;Modi ji did it frequently in the past,&#8221; added Mr. Sibal, an eminent advocate who on Saturday set out a new agenda and vision for the country with his newly-launched anti-injustice platform &#8216;Insaaf&#8217;</p>
<p>Mr. Sibal, who served as a Union minister during the UPA I and UPA II, resigned from the Congress in May 2012 and was elected to the Rajya Sabha as an independent with the support of the Samajwadi Party.</p>

<p>During his interactions in the United Kingdom, Mr. Gandhi asserted that the structures of Indian democracy and the institutions of the country are under attack.</p>
<p>Additionally, the former president of the Congress informed British parliamentarians in London that microphones are frequently &#8220;turned off&#8221; in the Lok Sabha when an opposition member raises an important issue.</p>
<p>Mr. Gandhi&#8217;s remarks sparked a political brawl, with the BJP accusing him of maligning India abroad and pursuing foreign intervention, and the Congress retaliating against the ruling party by citing instances of Prime Minister Modi bringing domestic politics to the international stage.</p>

<p>Sibal stated that everyone, including opposition leaders and ordinary citizens, was welcome to attend the celebration.He sought support for his initiative from opposition chief ministers and leaders.</p>
