										<content:encoded><![CDATA[<p>Montana became the first state in the US to ban TikTok on Wednesday, with the law scheduled to go into effect in 2019 as debate over the app&#8217;s impact and security intensifies.</p>
<p>The ban signed into law by Governor Greg Gianforte will serve as a legal test for a nationwide ban on the Chinese-owned platform, which Washington legislators are increasingly demanding.</p>
<p>&#8220;TikTok may not operate within the territorial jurisdiction of Montana,&#8221; according to a copy of the new law posted on the state&#8217;s website.</p>
<p>A violation of the restriction occurs whenever &#8220;a user accesses TikTok, is offered access to TikTok, or is offered the ability to download TikTok.&#8221;</p>
<p>Every day that a violation occurs, a $10,000 sanction is imposed.</p>
<p>According to the law, Apple and Google must remove TikTok from their app stores or face possible daily penalties.</p>
<p>The action will almost undoubtedly be challenged in court.</p>
<p>State political leaders have &#8220;trampled on the free speech of hundreds of thousands of Montanans who use the app to express themselves, gather information, and run their small businesses in the name of anti-Chinese sentiment,&#8221; according to Keegan Medrano, the ACLU Montana policy director.</p>
<p>The law stated that the prohibition will go into effect in 2024, but will be nullified if TikTok is acquired by a company incorporated in a country not designated as a foreign adversary by the United States.</p>
<p>&#8220;By unlawfully banning TikTok, Governor Gianforte has violated the First Amendment rights of the people of Montana,&#8221; a spokesperson for the company told AFP.</p>

<p>&#8220;We want to reassure Montanans that they can continue to use TikTok to express themselves, earn a living, and find community as we continue to defend the rights of our users in Montana and beyond.&#8221;</p>
<p>TikTok has stated publicly that the constitutionality of the suspension will ultimately be determined by the courts.</p>
<p>The law is the most recent skirmish between TikTok and numerous western governments, with the app already banned on government devices in the United States, Canada, and a number of European nations.</p>
<p>The app is owned by the Chinese company ByteDance, which vehemently contradicts allegations made by a large number of US politicians that it is under the control of the Chinese government and used for espionage.</p>
<p>Gianforte himself stated on Twitter that he signed the prohibition to &#8220;protect Montanans&#8217; personal and private data from the Chinese Communist Party.&#8221;</p>
<p>Despite its immense popularity, the White House has issued TikTok an ultimatum: either separate from its Chinese proprietors or cease operations in the United States.</p>
<p>Montana&#8217;s crackdown on TikTok comes as the app confronts national legislative proposals, including one that would grant the White House expansive new authority over Chinese technology companies.</p>

										<content:encoded><![CDATA[<p>The CEO of TikTok, Shou Zi Chew, testified before the US Congress amidst rising security concerns and the possibility of Chinese government influence on the company.</p>
<p>Chew was subjected to hostile questioning from the House Energy and Commerce Committee as he verbally juggled to prove that the social media behemoth is taking &#8220;real action&#8221; to address US national security concerns.</p>
<p>During a four-hour hearing, Chew repeatedly emphasized that the TikTok app, which is owned by the Chinese technology company Bytedance, has long maintained that it neither shares data with the Chinese government nor poses a threat to its 150 million US users, nor does it share their data with the Chinese Communist Party. (CCP).</p>
<p>During her line of questioning, US Representative Debbie Lesko cited India and other countries that have recently banned TikTok in some form.</p>
<p>&#8220;This (TikTok) is a tool that is ultimately controlled by the Chinese government, which raises serious national security concerns.&#8221; How can all of these nations and our FBI director be incorrect, Mr. Chew? asked Lesko.<br />
&#8220;I believe that many of the dangers cited are hypothetical and theoretical. Chew responded, &#8220;I have seen no evidence.&#8221;</p>
<p>The congresswoman reiterated and emphasized the India restriction once more. &#8220;India prohibited TikTok in 2020. The data of Indian users of TikTok remained accessible to employees of the company and its Beijing-based parent, according to a March 21 Forbes article. A current TikTok employee told Forbes that anyone with basic access to the company&#8217;s tools can readily access the closest contact information and other sensitive information about any user,&#8221; Lesko informed her colleagues.</p>
<p>&#8220;This is a recent article; I have requested that my team investigate it. We employ stringent data access protocols. There is no way that anyone could gain access to the instruments. Therefore, I disagree with many of the conclusions,&#8221; Chew replied.</p>
<p>Due to privacy and security concerns, India banned TikTok and dozens of other Chinese applications, including the messaging app WeChat, in 2020. The prohibition came shortly after a clash between Indian and Chinese troops at the LAC that resulted in the deaths of twenty Indian soldiers and the injuries of dozens more. The firms were given the opportunity to respond to queries regarding privacy and security requirements, but the ban became permanent in January 2021.</p>
<p>&#8220;You damn well know that you cannot protect the data and security of this committee or the 150 million users of your app because it is an extension of the CCP,&#8221; Florida lawmaker Kat Cammack told Chew after playing a threatening video that was still on the platform more than a month after it had been posted, despite community guidelines prohibiting threats and violence.</p>
<p>Republican representative Cathy McMorris-Rodgers posed the question during a congressional hearing, and TikTok&#8217;s chief was unable to &#8220;guarantee&#8221; that Beijing was not influencing portions of the app. Chew stated that the company is committed to protecting US user data from &#8220;all unwanted foreign access&#8221; and that it will keep content &#8220;free from any government manipulation.&#8221;</p>
<p>Another New Jersey lawmaker expressed doubt that TikTok&#8217;s security measures would be effective. &#8220;I still believe that the Beijing communist government will control and have the ability to influence what you do,&#8221; he said in response to TikTok&#8217;s attempt to portray itself as &#8220;a benign company that&#8217;s merely providing a public service&#8230; I don&#8217;t buy it.&#8221;</p>
<p>China repeatedly stated hours before the hearing that it would not oppose any forced sale of TikTok, with its Commerce Ministry stating that any sale would entail the export of Chinese technology and would require government approval.</p>

Responding to a media query over the TikTok ban during a press briefing, White House Press Secretary Karine Jean-Pierre said, &#8220;We have expressed concerns over China&#8217;s potential use of software platforms that could endanger or threaten America&#8217;s safety and national security so that is the President concerned that is why we have called on Congress to take action.&#8221;</p>
<p>We&#8217;ve seen a bipartisan bill that&#8217;s the President&#8217;s top goal. &#8220;I am sure when it comes to their safety, security, and our national security, those things are protected and so that has been the President&#8217;s focus over the last couple of years,&#8221; she added.</p>
<p>Sophia, who is reviewing this software and the TikTok app, favours the bipartisan legislation, the White House press secretary said in the press briefing.</p>
<p>&#8220;Look the bottom line is that when it comes to potential threats to our national security, the safety of Americans, privacy, we are going to speak out and we are going to be very clear about that and the Prez has been last 2 years and so we are asking Congress to act, to move forward with this bipartisan legislation that was the strict action that we just mentioned and we are going to continue to do so,&#8221; Pierre said.</p>
<p>After Senators introduced the &#8220;RESTRICT&#8221; Act, the White House Press Secretary made this remark. The Act would empower the US government to regulate dangerous innovations.</p>
<p>The group of Senators led by senators Mark Warner and John Thune introduced the Bill that seeks to address the ongoing threat posed by technology from foreign adversaries by empowering the US Department of Commerce to review, prevent, and mitigate information communications and technology transactions that pose risk to national security like TikTok.</p>
<p>Senator John Thune said Congress should stop treating technology from &#8220;adversarial nations that pose national security risks&#8221; gradually.</p>
<p>&#8220;Our country needs a process to address these risks, which is why I&#8217;m pleased to work with Senator Warner to establish a holistic, methodical approach to address the threats posed by technology platforms like TikTok from foreign adversaries,&#8221; Thune said.</p>

										<content:encoded><![CDATA[<p><strong>Cyber security threats:</strong> Thursday, the European Union Commission prohibited the use of the Chinese brief video-sharing application TikTok on corporate phones. EU industry chief Thierry Breton verified the development, citing a focus on cybersecurity as the reason for the move.</p>
<p>The EU executive was quoted by Reuters as saying, &#8220;To enhance its cybersecurity, the Commission&#8217;s Corporate Management Board has decided to suspend the use of the TikTok application on its corporate devices and on personal devices enrolled in the Commission mobile device service.&#8221;</p>
<p>&#8220;This measure seeks to protect the Commission from cybersecurity threats and actions that could be used to launch cyberattacks against the Commission&#8217;s corporate environment,&#8221; he said.In the meantime, the EU stated that no pressure from the United States played a role in the decision to require employees to remove TikTok from corporate phones.</p>
<p><strong>Tiktok Response</strong></p>
<p>The Chinese short video-sharing application stated that it was disappointed with the Commission&#8217;s decision because it was &#8220;misguided and founded on fundamental misunderstandings.&#8221;<br />
Reuters quoted a company spokesperson as saying, &#8220;We&#8217;ve contacted the Commission to set the record straight and explain how we safeguard the data of the 125 million EU residents who visit TikTok every month.&#8221;</p>
<p><strong>EU&#8217;s strict rules</strong></p>
<p>Last week, media reports that tech titans including Facebook, Google, Twitter, and TikTok will be subject to stricter online content regulations in the European Union began to circulate.</p>
<p>The new regulations, known as the Digital Services Act (DSA), classify companies with more than 45 million users as very large online platforms (VLOPs) and mandate risk management and external and independent auditing.In addition, they will be required to share data with authorities and researchers and adhere to a code of conduct.</p>
