<p>&#8220;Bhausaheb acknowledged his error and expressed regret for it. He departed the party without ever attempting to harm it. We in Shiv Sena can forgive errors, but not those who are attempting to destroy the party. Thackeray stated, presumably in allusion to chief minister Eknath Shinde and his supporting MPs and MLAs, that party workers would teach them a lesson in the upcoming elections.</p>
<p>Wakchaure stated, &#8220;We will once again strengthen the party in Shirdi, Maharashtra, and across the country.&#8221;</p>

<p>Wakchaure served as Shiv Sena MP for Shirdi between 2009 and 2014. Then he shifted to the Congress and ran for a Lok Sabha seat, but lost to Sadashiv Lokhande of the Sena. In the subsequent six months, he defected to the BJP, ran for the Shrirampur assembly seat in Ahmednagar district, and lost to Bhausaheb Kamble of the Congress. With the addition of Lokhande to the Shinde contingent, the Thackeray faction is likely to nominate Wakchaure from Shirdi in the upcoming Lok Sabha election.</p>
<p>Thackeray added that he would shortly visit Shirdi to seek Sai Baba&#8217;s blessings and would also hold a public rally there. There will be a transition of power in Maharashtra and at the centre in the upcoming elections.</p>
<p>Thackeray has accelerated preparations for the Lok Sabha election and will convene a meeting of all party tehsil chiefs on September 2 in Mumbai. In 2019, his party won 18 seats, but 13 of them transferred allegiance to Shinde.</p>
<p>Since August 16, Thackeray has been searching for candidates in these constituencies and presiding over continuous review meetings. He has assessed the situation in northern Maharashtra and a portion of western Maharashtra thus far. This week, he will conduct constituent meetings in the Vidarbha region.</p>

<p>Meanwhile, Thackeray indicated that former minister of the union Anant Geete would represent the party in Raigad. Geete lost the 2019 election to Sunil Tatkare of the NCP, resulting in his marginalisation. Sena (UBT) is anticipated to receive the Raigad constituency in a seat-sharing arrangement with NCP and Congress, MVA partners. Geete is a member of the Kunbi community, which is prominent in the Konkan region, particularly in the Raigad and Ratnagiri districts.</p>

<p>Former Maharashtra CM Uddhav Thackeray stated on Monday that he never wanted to be cM, but rather wanted the position for the Shiv Sena, as he had promised to his late father Balasaheb Thackeray.</p>
<p>Uddhav&#8217;s tour coincides with an intense political crisis in Maharashtra, as the Nationalist Congress Party has divided between Sharad Pawar and Ajit Pawar, with Ajit Pawar&#8217;s faction joining the government. This is the second party separation in the past year, following Eknath Shinde&#8217;s rebellion against Uddhav Thackeray and the division of the Shiv Sena.</p>
<p>Monday, Uddhav continued his tirade against the BJP by stating that parties breaking is nothing new, but now they are being hijacked. As Uddhav made this claim against the Election Commission regarding the Shiv Sena name, the Supreme Court agreed on Monday to hear the Uddhav faction&#8217;s petition on July 31 &#8212; against the EC&#8217;s order that the Shiv Sena name and the symbol of the bow and arrow be given to the Eknath Shinde faction.</p>

										<content:encoded><![CDATA[<p>In an affidavit lodged with the Supreme Court, the Election Commission defended its decision to grant the party names &#8220;Shiv Sena&#8221; symbol and &#8220;Bow and Arrow&#8221; to the faction led by Maharashtra Chief Minister Eknath Shinde.</p>
<p>The EC stated in the affidavit that the order was well-reasoned and addresses all of the concerns raised by the Uddhav Camp.</p>
<p>The affidavit was submitted in response to a petition filed by Uddhav Thackeray challenging Election Commission&#8217;s decision to grant the party names &#8220;Shiv Sena&#8221; and &#8220;Bow and Arrow&#8221; to the faction led by Maharashtra Chief Minister Eknath Shinde.</p>
<p>Election Commission stated that it issued the challenged order dated 17 February 2023 in the exercise of its quasi-judicial powers under the Election Symbols (Reservation and Allotment) Order, 1968. (Symbols Order).</p>
<p>EC argued that the challenged order was not issued by the Commission in its administrative capacity, but rather in a quasi-judicial capacity pursuant to the Symbols Order.</p>
<p>However, EC chose not to make any arguments on the merits of the case and stated that its decision was well-reasoned and addresses all of the Petitioner&#8217;s concerns. &#8220;Therefore, the Election Commission has become functus officio in this case, as it has already fulfilled its duty to adjudicate the petition submitted under Paragraph 15 of the Symbols Order following the issuance of the challenged order,&#8221; the affidavit stated.</p>
<p>The EC also argued that, in a multitude of cases, the courts have held that, when an order issued by a quasi-judicial body is challenged before an appellate court, the quasi-judicial body need not be named as a party to the appeal.</p>
<p>Prior to this, Uddhav Thackeray challenged the Election Commission&#8217;s decision to give the party name &#8220;Shiv Sena&#8221; and the symbol &#8220;Bow and Arrow&#8221; to the faction commanded by Maharashtra Chief Minister Eknath Shinde.</p>
<p>In his petition against the Election Commission&#8217;s decision to grant the party name &#8220;Shiv Sena&#8221; and the symbol &#8220;Bow and Arrow&#8221; to the faction led by Maharashtra Chief Minister Eknath Shinde, Uddhav Thackeray argued that the ECI failed to take into account his faction&#8217;s majority in the Legislative Council and Rajya Sabha.</p>
<p>Uddhav Thackeray argued in his petition that the legislative majority alone could not be the foundation for the EC&#8217;s order in this instance.</p>
<p>Uddhav Thackeray argued that the EC&#8217;s decision was erroneous, stating that &#8220;the entire edifice of the impugned order (EC&#8217;s decision) is founded on the purported legislative majority of the Respondent (Shinde), which is a matter to be decided by the apex court&#8217;s Constitution Bench.&#8221;</p>
<p>Uddhav Thackeray stated that the ECI erred in concluding that there is a split in the political party and argued, &#8220;in the absence of any pleadings and evidence that there was a split in a political party, the ECI&#8217;s finding on this ground is entirely erroneous.&#8221;</p>
<p>Uddhav Thackeray argued that the ECI has failed to recognise that the Petitioner enjoys overwhelming support from the party&#8217;s rank and file. He stated that his faction holds an overwhelming majority in the Pratinidhi Sabha, the supreme representative body representing the desires of the Primary members and other party stakeholders.</p>
<p>Uddhav Thackeray, in raising questions about the Election Commission, stated that the commission disregards the constitutionality test by asserting that the party&#8217;s constitution cannot be considered sacred because it cannot be deemed &#8216;democratic.&#8217;</p>

<p>Uddhav Thackeray argued that the ECI has failed to fulfil its responsibilities as a neutral dispute arbitrator and has acted in a manner that undermines its constitutional standing.</p>
<p>The ECI has disregarded the 2018 party constitution, which was acknowledged by the Respondent Shinde to be the party constitution, on the grounds that such a constitution is undemocratic and that the Commission was not informed of its existence.</p>

<p>Bhushan Desai joined the Shinde faction while the chief minister was present.</p>
<p>After Subhash  Desai joined the party, Chief Minister Shinde told the media, &#8220;Many stalwart leaders who worked with Balasaheb Thackeray have joined us since the beginning of our revolt.&#8221;</p>
<p>He stated that the party is committed to Balasaheb Thackeray&#8217;s ideology and to the common man&#8217;s welfare. &#8220;With this in mind, Bhushan Desai has decided to join our party and work with us,&#8221; Shinde said.</p>
<p>Bhushan Desai stated on this occasion, &#8220;Balasaheb Thackeray is my idol. Currently, Chief Minister Eknath Shinde carries on the Hindutva legacy begun by Balasaheb Thackeray.&#8221;</p>
<p>Bhushan Desai stated that his close observation of Eknath Shinde&#8217;s work led him to join the Shiv Sena, which is led by Chief Minister Eknath Shinde.</p>
<p>The Election Commission of India (ECI) assigned the party name &#8220;Shiv Sena&#8221; and the symbol &#8220;Bow and Arrow&#8221; to the faction led by Maharashtra Chief Minister Eknath Shinde on February 17, dealing a significant blow to the Uddhav Thackery faction of Shiv Sena.</p>
<p>While the Shinde faction applauded the decision to recognise them as the legitimate Shiv Sena, the Uddhav Thackeray faction announced that they will appeal to the Supreme Court.</p>
<p>In its order, the Commission noted that the current constitution of the Shiv Sena party is undemocratic and has been &#8220;mutilated to undemocratically appoint office bearers from a coterie without any election whatsoever.&#8221; It was stated that these party structures do not inspire confidence.</p>
<p>The polling panel advised all political parties to reflect democratic ethos and principles of inner party democracy and to regularly disclose on their respective websites aspects of their inner party functioning, such as organisational information, elections, the Constitution, and a list of office bearers.</p>
<p>&#8220;The constitutions of political parties should provide for free, fair, and transparent elections to office-bearer positions, as well as a free and fair procedure for resolving internal disputes. These procedures should be difficult to change and should only be amendable after gaining the support of a majority of the organization&#8217;s members, according to the ECI.</p>
<p>Last month, both the Shinde-led and Thackeray-led factions of the Shiv Sena submitted written statements to the Election Commission in support of their respective claims regarding the party&#8217;s name and symbol.</p>
<p>The ECI froze the bow and arrow symbol of the Shiv Sena and assigned the &#8216;Two Swords and Shield symbol&#8217; to the Eknath Shinde faction of the Shiv Sena, while the &#8216;flaming torch&#8217; (mashaal) was assigned to the Uddhav Thackeray faction for the byelection in the Andheri East assembly constituency in November of last year.</p>

<p>Last year, a split within the Shiv Sena forced Uddhav Thackeray to resign as chief minister of the Maha Vikas Aghadi government. Shinde later joined forces with the BJP to form the state&#8217;s government.</p>

										<content:encoded><![CDATA[<p>Former Maharashtra chief minister Uddhav Thackeray escalated his criticism of the Election Commission on Saturday, a day after the commission gave the Shiv Sena party name and the bow-and-arrow emblem to his competitor and successor, Eknath Shinde.<br />
&#8220;The Election Commission, Prime Minister [Narendra] Modi&#8217;s slave, has done something unprecedented,&#8221; he remarked, asking his followers to be patient and prepare for the next polls &#8211; the high-stakes race for Mumbai&#8217;s civic body BMC.</p>
<p>Mr. Thackeray addressed a big crowd gathered as a show of force in front of the Thackerays&#8217; residence, Matoshree.He stood out of the sunroof of his automobile, echoing the image of his father Bal Thackeray, who in the early days of the party would address supporters from the roof of his car.</p>
<p>The party&#8217;s symbol has been &#8220;taken,&#8221; and the &#8220;thief&#8221; must be punished, Uddhav Thackeray said, referring to Mr Shinde, the Chief Minister of Maharashtra.<br />
The Election Commission handed over the identity of the party formed by Mr. Thackeray&#8217;s father in 1966 to Mr. Shinde on Friday, capping a coup that has lasted nearly eight months.</p>
<p>The team of Mr. Thackeray, who had urged the Election Commission to wait for a Supreme Court ruling in the case, has stated that they will appeal the judgement to the highest court. The Supreme Court is weighing in on the dispute between the two sides.</p>
<p>Mr. Shinde had instigated a revolt in June, leading over 40 Sena MLAs to defect with the support of the BJP, ultimately leading to the removal of Mr. Thackeray&#8217;s cabinet, which included two ideologically divergent allies in the Congress and the National Congress Party.</p>
<p>In a 78-page ruling about the protracted struggle for leadership of the party, the Election Commission stated that Mr. Shinde had the backing of MLAs who won 76% of the party&#8217;s votes in the 2019 Maharashtra assembly elections.</p>

<p>The election commission stated that the Uddhav Thackeray faction may retain the name &#8220;Shiv Sena Uddhav Balasaheb Thackeray&#8221; and the symbol of a &#8220;flaming flame&#8221; assigned last year.Eknath Shinde hailed the decision as a &#8220;win for democracy&#8221; and, in response to Mr. Thackeray&#8217;s labelling of him as a &#8220;traitor,&#8221; stated that his opponent needed to &#8220;introspect.&#8221;</p>
