Victoria Gowri sworn in as Madras HC judge; SC dismisses petition

Acting Chief Justice of the Madras High Court, T Raja, administered the oath of office to Victoria Gowri, and four others on Tuesday.

Lekshmana Chandra Victoria Gowri was being sworn in as a judge of the Madras High Court when the Supreme Court today denied petitions asking to prevent her from taking the oath. The supreme court hearing was still going on when the swearing-in ceremony began.

“We aren’t looking at the writ petitions. I’ll give reasons later “Justices Sanjiv Khanna and Bhushan Ramkrishna Gavai made the statement on a special bench.

There is a distinction between eligibility and suitability, Justice Khanna stated at the start of the session. “There might be a problem with eligibility. However, appropriateness To avoid the process going awry, the courts shouldn’t get involved in suitability “He watched.

Senior attorney Raju Ramachandran argued that the decision-making process was hampered because pertinent information was not provided to the collegium. He had previously asked the court for urgent intervention because the Centre had announced the appointment of Ms. Gowri. The judges claimed to have read every document filed.

Regarding his political background, Justice Gavai stated that although it existed, it did not interfere with his performance of his duties.

“The issue at hand is not at all political backdrop. It’s offensive rhetoric. Hate speech that is utterly incompatible with the Constitution. She cannot take an oath because of this. The oath will only be on paper “Then Mr. Ramachandran argued.

Due to allegations that Ms. Gowri had made hateful remarks against Christians and Muslims, certain bar members of the Madras High Court wrote to the Chief Justice of India asking for the recommendation to appoint her as an additional judge of the high court to be withdrawn. Following rumours of Ms. Gowri’s supposed affiliation with the BJP, the projected promotion of Ms. Gowri has been dogged by controversy.
